1. Acceptance of Terms

These Terms and Conditions (hereinafter "Terms") govern your access to and use of the top64 gaming platform, website, mobile applications, and all related services (collectively, the "Service"). The Service is operated by top64 (hereinafter "we," "us," "our," or "top64"), a licensed online gaming operator authorized to provide gaming services to eligible players in the Philippines.

By registering for a top64 account, depositing funds, placing bets, or otherwise using any aspect of the Service, you enter into a binding legal agreement with top64 and agree to comply with these Terms, our Privacy Policy, Responsible Gaming Policy, and all applicable laws and regulations governing online gaming in the Philippines. These Terms apply to all users of the Service, including registered players, visitors, and any other persons who access or use the Service in any manner.

We reserve the right to modify, amend, or update these Terms at any time without prior notice. Any changes will become effective immediately upon posting to the top64 website. Your continued use of the Service following any such changes constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically to stay informed of any updates. The current version of these Terms will always be available on our website with the most recent revision date clearly indicated.

2. Eligibility Requirements

To register for and use top64 services, you must meet all of the following eligibility requirements without exception:

• Age Requirement: You must be at least twenty-one (21) years of age at the time of registration. top64 strictly prohibits access to the Service by minors. We reserve the right to request proof of age at any time, and failure to provide satisfactory documentation will result in immediate account suspension and forfeiture of all funds.
• Legal Capacity: You must have the legal capacity to enter into binding contracts under the laws of your jurisdiction. You may not use the Service if you are subject to any legal disability that would prevent you from entering into or performing your obligations under these Terms.
• Geographic Restrictions: You must be physically located in a jurisdiction where participation in online gaming is legal. You are solely responsible for ensuring that your use of top64 complies with all applicable laws in your location. top64 does not accept players from jurisdictions where online gaming is prohibited by law.
• Account Limitations: You may maintain only one (1) account with top64. Creating multiple accounts is strictly prohibited and will result in immediate closure of all accounts and forfeiture of all balances and winnings. This restriction applies regardless of whether you use different email addresses, names, addresses, or payment methods.
• Self-Exclusion Status: You must not be subject to any self-exclusion order, gambling ban, or other restriction that would prohibit you from participating in online gaming activities. If you have previously self-excluded from top64 or any other gaming operator, you may not register for or use the Service during the exclusion period.

By registering for top64, you represent and warrant that you meet all eligibility requirements stated above. You acknowledge that top64 relies on these representations in accepting your registration and providing you access to the Service. Any breach of these eligibility requirements constitutes a material violation of these Terms and may result in immediate account closure, forfeiture of funds, and potential legal action.

3. Account Registration and Security

3.1 Registration Process

To access most features of the top64 Service, you must complete the account registration process by providing accurate, complete, and current information as requested on the registration form. Required information includes, but is not limited to, your full legal name, date of birth, email address, mobile phone number, physical address, and preferred payment method details. You must use your own personal information and may not register using another person's details or false information.

During registration, you will create login credentials consisting of a username and password. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, whether or not authorized by you. You agree to immediately notify top64 of any unauthorized use of your account or any other breach of security. top64 will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.2 Identity Verification

top64 employs a comprehensive Know Your Customer (KYC) verification process to prevent fraud, money laundering, underage gaming, and other illegal activities. As part of this process, you may be required to submit documentation proving your identity, age, and address. Acceptable documents include government-issued identification cards, passports, utility bills, bank statements, and other documents as we may request from time to time.

We reserve the right to request additional verification documents at any time, including before processing withdrawal requests. Your account may be temporarily suspended until satisfactory verification is completed. Failure to provide requested documentation within a reasonable timeframe, or provision of fraudulent or altered documents, will result in permanent account closure and forfeiture of all funds. All verification documents are processed in accordance with our Privacy Policy and applicable data protection laws.

3.3 Account Security Obligations

You are responsible for maintaining appropriate security measures to protect your top64 account. This includes using a strong, unique password, enabling two-factor authentication if available, keeping your contact information current, logging out after each session on shared devices, and never sharing your login credentials with any third party. You must immediately notify top64 if you suspect any unauthorized access to your account or if your device is lost, stolen, or compromised.

4. Deposits and Withdrawals

4.1 Deposit Methods and Procedures

top64 accepts deposits through various payment methods including GCash, PayMaya, bank transfers, and other options as displayed in your account dashboard. All deposits must be made from payment accounts registered in your own name. Third-party deposits are strictly prohibited and will result in the deposit being returned (minus processing fees) and potential account closure. Minimum and maximum deposit amounts vary by payment method and are clearly displayed during the deposit process.

Deposited funds will be credited to your top64 account balance typically within minutes for e-wallet transactions and up to several business days for bank transfers, depending on the payment method and financial institution processing times. top64 is not responsible for delays caused by third-party payment processors or banking institutions. All deposits are final and non-refundable except in cases of technical error or as required by law.

4.2 Withdrawal Policies

You may request withdrawal of your available account balance at any time, subject to completion of any applicable wagering requirements and verification procedures. Withdrawals will be processed to the same payment method used for deposit unless alternative arrangements are approved by top64 for security or regulatory reasons. All withdrawal requests are subject to identity verification, anti-fraud checks, and anti-money laundering procedures before processing.

Minimum withdrawal amounts apply and vary by payment method. Withdrawal processing times depend on the chosen method, with e-wallet withdrawals typically processed within 24 hours and bank transfers within 1-5 business days. top64 reserves the right to request additional documentation or information before processing large withdrawals or withdrawals from accounts that have not completed full verification. Any bonuses or promotional funds must meet stated wagering requirements before the associated winnings become eligible for withdrawal.

4.3 Anti-Money Laundering Compliance

top64 maintains strict anti-money laundering (AML) policies in accordance with Philippine law and international standards. We reserve the right to conduct enhanced due diligence on any account or transaction that we deem suspicious or that triggers our internal monitoring systems. You agree to provide any additional information or documentation we request for AML purposes. Failure to cooperate with AML procedures or evidence of money laundering activity will result in account closure, reporting to relevant authorities, and forfeiture of funds.

5. Gaming Rules and Fair Play

5.1 Game Integrity

All games available on top64 utilize certified Random Number Generators (RNG) that have been tested and certified by independent gaming laboratories to ensure fair and random outcomes. The RNG determines game results in a manner that cannot be predicted or manipulated by top64 or players. We publish Return to Player (RTP) percentages for all games in accordance with regulatory requirements and industry best practices.

Game rules, payout tables, and RTP percentages are available within each game's information section. You are responsible for understanding the rules of any game before placing bets. In the event of a dispute regarding game outcome, top64's game logs and server records will be considered the authoritative source for determining the correct result. All gaming disputes will be resolved in accordance with Section 10 of these Terms.

5.2 Betting Limits and Responsible Gaming

Each game on top64 has specified minimum and maximum betting limits which are clearly displayed. You may not circumvent betting limits by opening multiple accounts or colluding with other players. top64 encourages responsible gaming practices and provides tools allowing you to set personal deposit limits, loss limits, session time limits, and cooling-off periods. Once set, these limits cannot be increased immediately but may be decreased at any time.

5.3 Game Malfunction

In the rare event of game malfunction, technical error, or network interruption, all affected bets may be deemed void, and your stake will be refunded. top64 is not liable for any losses or missed winnings resulting from game malfunctions, software errors, or connectivity issues beyond our reasonable control. If you experience any technical issues during gameplay, you must immediately cease play and contact customer support.

6. Bonuses and Promotions

top64 offers various bonuses, promotions, and rewards to players from time to time. All bonuses are subject to specific terms and conditions which are clearly stated in the promotional materials and must be reviewed before claiming any bonus. General bonus terms include wagering requirements, game restrictions, maximum bet limits, time limits, and maximum withdrawal amounts from bonus winnings.

Bonuses are intended for recreational players and may not be abused for guaranteed profit or arbitrage strategies. top64 reserves the right to void bonuses, cancel associated winnings, and close accounts of players found to be bonus abusing, including but not limited to engaging in irregular play patterns, low-risk betting, betting opposite sides, or any other strategy designed to abuse bonus offers. Unless explicitly stated otherwise, bonuses are available once per player, household, IP address, and payment method.

You may not withdraw deposited funds without meeting applicable wagering requirements if you have claimed a bonus on that deposit. Attempting to withdraw funds before completing wagering requirements will result in forfeiture of the bonus and any winnings derived from it. top64 reserves the right to modify, suspend, or cancel any promotion at any time without prior notice. Changes to promotions do not affect bonuses already credited to player accounts unless required by law or due to technical error.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities while using top64 services:

• Fraudulent Behavior: Using stolen payment methods, providing false information, creating multiple accounts, colluding with other players, or engaging in any form of fraud or deception.
• Bonus Abuse: Exploiting bonuses or promotions contrary to their intended recreational purpose, including but not limited to arbitrage betting, low-risk strategies, opposite betting, or coordinated group play.
• Technical Exploitation: Exploiting software vulnerabilities, using bots or automated systems, reverse engineering our software, or manipulating games or systems in any manner.
• Money Laundering: Using top64 services to launder money or conduct illegal financial transactions, including depositing and withdrawing funds without reasonable gaming activity.
• Circumventing Restrictions: Using VPNs or proxy servers to conceal your location, accessing the Service from restricted jurisdictions, or attempting to circumvent any technical restrictions we implement.
• Offensive Conduct: Engaging in abusive, harassing, or offensive behavior toward other players or top64 staff, including in chat features, customer support interactions, or social media.
• Unauthorized Use: Allowing third parties to use your account, sharing account credentials, or accessing another player's account without authorization.

Violation of any prohibited activity will result in immediate account suspension or closure, forfeiture of all account balances and pending winnings, and potential legal action including reporting to law enforcement authorities. top64 may also share information about prohibited activities with other gaming operators and regulatory authorities to prevent further violations across the industry.

8. Account Suspension and Termination

8.1 Termination by Player

You may close your top64 account at any time by contacting customer support and requesting account closure. Upon closure, you must withdraw any remaining account balance, subject to applicable wagering requirements and verification procedures. Account closure does not relieve you of any obligations or liabilities incurred prior to closure. Closed accounts cannot be reopened, and you must wait a minimum period before registering a new account.

8.2 Termination by top64

top64 reserves the right to suspend or permanently close your account at any time, with or without cause, including but not limited to: violation of these Terms, breach of any law or regulation, fraudulent or suspicious activity, failure to provide requested verification documents, abusive behavior, or risk management decisions. We will provide notice of account closure when legally required, but are not obligated to provide reasons for our decision in all cases.

Upon account closure by top64, we will return any remaining account balance to you minus any amounts owed to top64, applicable fees, or confiscated winnings resulting from Terms violations. In cases of serious violations including fraud, money laundering, or bonus abuse, top64 may confiscate all account funds and report the matter to relevant authorities. Decisions regarding account closure and fund confiscation are final and not subject to appeal except as required by applicable law or regulation.

9. Limitation of Liability

To the fullest extent permitted by law, top64, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) any other matter relating to the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In jurisdictions where limitation of liability is not permitted, our liability to you is limited to the maximum extent permitted by law. In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to top64 in the six (6) month period prior to your claim, or One Thousand Philippine Pesos (PHP 1,000), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

You acknowledge and agree that online gaming involves an element of chance and that there is always a risk of losing money. top64 does not guarantee that you will win money or that your use of the Service will be profitable. You use the Service at your own risk and are solely responsible for any losses you may incur. top64 is not liable for any losses resulting from your gaming decisions, betting strategies, or account management.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Metro Manila, Philippines for resolution of any disputes arising from these Terms or your use of top64 services.

10.2 Dispute Resolution Process

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your use of top64, you agree to first contact our customer support team to attempt to resolve the matter informally. Most disputes can be resolved quickly and amicably through direct communication. You must provide top64 with reasonable opportunity to address your concerns before pursuing formal dispute resolution procedures.

If the dispute cannot be resolved through customer support within thirty (30) days, either party may submit the dispute to formal mediation administered by a mutually agreed upon mediator in Metro Manila, Philippines. The costs of mediation shall be borne equally by both parties unless otherwise agreed. If mediation fails to resolve the dispute within sixty (60) days of commencement, either party may pursue resolution through the courts as specified in Section 10.1.

10.3 Class Action Waiver

To the extent permitted by law, you and top64 agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action. Unless both you and top64 agree otherwise, the arbitrator or court may not consolidate or join more than one person's or party's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding. Any relief awarded cannot affect other top64 users.
